This privacy policy describes how SERSO Investigations, operated by Sergio de Sousa, collects, uses, discloses, and protects personal information gathered through the website at sersoinvestigations.ca.

Section 3 Use of information

Section 4 Matter confidentiality
SERSO Investigations recognises that enquiries and information shared in the context of a potential or active engagement may involve matters that are legally sensitive, subject to solicitor-client privilege, or otherwise confidential.
Confidentiality commitment
All matter-related information shared with SERSO Investigations — whether through the enquiry form, by email, by telephone, or in the course of an engagement — is treated as strictly confidential. It is used only for the purpose of the specific matter for which it was shared, and is not disclosed to any third party without the express written consent of the instructing lawyer or client, except as required by law.
Where SERSO Investigations is engaged by a lawyer on behalf of a client, the confidentiality obligations owed to that client are understood to be co-extensive with those owed to the instructing lawyer under applicable professional conduct rules.
Section 5 Retention & deletion
Personal information collected through the enquiry form is retained only for as long as is necessary to respond to your enquiry or, where an engagement proceeds, to fulfil the obligations of that engagement and any applicable record-keeping requirements.
Enquiries that do not result in an engagement are not retained beyond the period reasonably required to respond. Where an engagement does proceed, records relating to that engagement are retained in accordance with sound professional practice and any applicable legal or regulatory requirements, and are securely deleted when no longer required.
All personal information is stored on infrastructure located in Canada and controlled by SERSO Investigations. No personal information is transferred to servers or service providers outside Canada.
Section 6 Your rights under PIPEDA

Access: request access to the personal information SERSO Investigations holds about you.
Correction: request that inaccurate or incomplete personal information be corrected.
Withdrawal of consent: withdraw consent to the collection or use of your personal information at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawal of consent may affect the ability to respond to an enquiry or continue an engagement.
Complaint: if you believe your privacy rights have been violated, you may file a complaint with the Office of the Privacy Commissioner of Canada at priv.gc.ca.

Section 7 Electronic communications — CASL
Canada's Anti-Spam Legislation (CASL, S.C. 2010, c. 23) governs the sending of commercial electronic messages. By submitting the enquiry form on this website, you provide express consent to receive electronic communications from SERSO Investigations for the purpose of responding to your enquiry and, if an engagement proceeds, in connection with that engagement.
SERSO Investigations does not send unsolicited commercial electronic messages. You may withdraw your consent to receive electronic communications at any time by notifying SERSO Investigations using the contact details in Section 9 below.
Section 8 Quebec residents — Law 25
Quebec's Act respecting the protection of personal information in the private sector (Law 25 / Bill 64), as amended and in full force since September 2023, applies to personal information collected from residents of Quebec.
In addition to the rights described in Section 6, Quebec residents have the right to data portability and the right to request the de-indexing of personal information in certain circumstances. Quebec residents who believe their rights under Law 25 have been violated may also file a complaint with the Commission d'accès à l'information du Québec at cai.gouv.qc.ca.

Section 10 Professional disclaimer
SERSO Investigations provides specialist forensic technology and litigation support services, with a focus on electronic evidence extraction, analysis, and court-ready preparation. These services are offered on the basis of the principal's professional background in software engineering, data systems, and forensic data analysis.
These services are offered independently of private investigations agency operations. SERSO Investigations does not hold a private investigations agency licence under the Private Security and Investigative Services Act, 2005 (Ontario) at this time. No representation is made that the services described on this website constitute private investigation services within the meaning of that Act or any other applicable legislation.
